Legal framework of the permit file: Law No. 3194 and the Planned Areas Regulation

A building permit for a prefabricated or light steel house is obtained under Articles 21 and 22 of Zoning Law No. 3194, by applying to the zoning directorate of the relevant municipality. It is not the type of structure but the zoning status of the parcel and the completeness of the file that determines whether the permit is granted.

The Planned Areas Zoning Regulation defines the minimum content of the projects and annexes required in the permit file. If this content is not met, the file is returned; therefore, comparing the documents against the regulation checklist before applying prevents the process from extending by weeks.

Land documents: deed, survey map and zoning status document

The first three core documents of the permit file establish the legal identity of the parcel. The deed copy shows the owner and the type of parcel, the survey map (building application sketch) shows the boundaries and dimensions, and the zoning status document defines the limits of what can be built. Without these three, the technical project stage cannot start.

The zoning status document includes the parcel's ground area ratio (TAKS), floor area ratio (KAKS), maximum building height, setback distances and plan notes. Since the architectural project is drawn within these limits, the document must be current and approved; in most municipalities, a zoning status older than one year must be renewed.

The technical core of the permit file consists of four projects. The architectural project includes plans, sections and elevations; the structural project covers load calculations and details of the bearing system; the electrical project defines lighting, sockets and the panel; the mechanical project defines plumbing, heating and ventilation. The four projects reference each other and are usually submitted in the same file.

For light steel and prefab structures, the structural project must be based on Turkish Building Earthquake Code (TBDY 2018) calculations and aligned with the system manufacturer's type projects. The architectural project must show prefab panel thicknesses, light steel profile types and sandwich panel class on the drawings; otherwise the project is returned at the technical office stage.

Under the Building Earthquake Code, a geotechnical or geological-geotechnical survey report is mandatory for every new structure; without it, the structural project is not approved.

The building inspection contract is signed between the property owner and a building inspection firm under the Building Inspection Law No. 4708. A file without a contract is not accepted. The inspection firm reports every step from project approval to construction-stage controls; these reports are submitted to the municipality during the occupancy stage.

  • Geotechnical or geological-geotechnical soil survey report is mandatory.
  • The survey is prepared by licensed geological and civil engineers.

System documents for light steel and prefab: TSE, CE and system structural report

Unlike traditional reinforced concrete, light steel (cold-formed steel) and prefab panel structures contain factory-produced system components. The TSE certificate, CE conformity mark and system structural report of these components must be added to the permit file. The municipal technical office evaluates the structural project together with these documents.

For sandwich panels, the fire class (typically A2-s1, d0 or B-s1, d0) and thermal conductivity (U-value) certificates are submitted; for the building envelope, EPS/XPS/rockwool thickness and density certificates are added. For light steel profiles, galvanized coating (Z275 or above) certificate and bolt connection class (e.g. 8.8) documents prove that the system complies with the regulations.

  • TSE or TSEK certificate: conformity with Turkish standards.
  • CE conformity mark and Declaration of Performance (DoP).
  • System structural report: type calculation report from the manufacturer.
  • Sandwich panel fire class and U-value certificate.
  • Galvanized coating (Z275 and above) and profile tensile strength certificates.
  • Connection elements (8.8 class bolts) quality certificate.

Missing-document scenarios and practices that accelerate the file

In files submitted to the municipal zoning directorate, the most common deficiencies are an expired zoning status document, a soil survey report from the neighbouring parcel rather than the actual one, and a building inspection contract submitted without YIBF registration. These three errors alone can delay the file by 2-4 weeks.

For light steel and prefab structures, the most frequent reason for return is missing system structural reports and TSE/CE documents. Including the manufacturer's technical office in the file from the very beginning, and drawing the architectural and structural projects in line with the system documents, brings the permit duration down to an average of 30-45 days.
